1. Acceptance of Terms

By accessing or using the Custom Cut Butcher website and online ordering platform ("Service"), you agree to be bound by these Terms of Service. If you do not agree, please do not use the Service. These terms apply to all visitors, customers, and account holders.

2. About Our Service

Custom Cut Butcher operates a retail butcher shop at 670 C River Oaks Pkwy, San Jose, CA 95134. This website allows customers to browse our menu, create an account, and place orders for in-store pickup or local delivery. Orders are fulfilled by our team on-site.

3. Customer Accounts

You may create an account using your email address and a password. You are responsible for keeping your login credentials confidential and for all activity that occurs under your account. Notify us immediately if you suspect unauthorized access. We reserve the right to suspend or terminate accounts that violate these terms or are used fraudulently.

4. Ordering and Pricing

All prices are listed per pound unless otherwise noted. Because every item is cut fresh to order, the final weight — and therefore the final price — may differ slightly from your checkout estimate.

• If the actual weight is higher than estimated, we will charge the difference to the card on file and email you a receipt.
• If the actual weight is lower than estimated, we will refund the difference to the original payment method.

By placing an order you authorize us to make these adjustments. We aim to keep any variance to a minimum.

5. Payment

We accept credit and debit cards (processed by Stripe) and cash at pickup. Card transactions are encrypted and handled by Stripe — we do not store your full card number. A saved payment method may be kept on file to facilitate weight-adjustment charges or refunds described in Section 4. You may request removal of a saved card by contacting us.

6. Pickup and Delivery

• Pickup orders should be collected during store hours. Orders not picked up may be held at our discretion; we are not responsible for items left uncollected.
• Delivery orders are subject to our current delivery area, minimum order amounts, and delivery fees displayed at checkout. Delivery times are estimates and may vary.
• Scheduled orders will be prepared for your selected date and time. Please contact us as soon as possible if you need to cancel or reschedule.

7. Cancellations and Refunds

Because items are cut to order, we cannot guarantee cancellation once preparation has begun. If you need to cancel, call us immediately at (408) 331-4020. Refunds for cancelled orders will be issued to the original payment method and may take 5–10 business days to appear, depending on your bank.

8. Product Availability

Menu items and prices are subject to change without notice based on availability and market conditions. If an item you ordered is unavailable, we will contact you to discuss substitutes or a refund.

9. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose.
• Create fake or duplicate accounts.
• Attempt to access, tamper with, or disrupt our systems or data.
• Submit false or fraudulent orders.

We reserve the right to refuse service or cancel orders at our discretion.

10. Limitation of Liability

To the fullest extent permitted by law, Custom Cut Butcher shall not be liable for any indirect, incidental, or consequential damages arising from your use of the Service. Our total liability for any claim arising out of or relating to these terms shall not exceed the amount you paid for the order giving rise to the claim.

11. Governing Law

These terms are governed by the laws of the State of California, without regard to its conflict-of-law provisions. Any disputes will be resolved in the courts located in Santa Clara County, California.

12. Changes to These Terms

We may update these terms from time to time. We will post the revised version on this page with an updated date. Continued use of the Service after changes are posted constitutes acceptance of the revised terms.
